The exemptions for non-operating foreign companies’ regulation
Issued pursuant to Article 248, paragraph (i), of the Companies Law No. 22 of 1997
Article (1):
This Regulation shall be called (the exemptions for non-operating foreign companies’ regulation for the year 2017) and shall come into force as of the date of its publication in the Official Gazette.
Article (2):
- The following words wherever used in this Regulation, shall have the meanings hereunder assigned to them, unless the context otherwise provides:
The Law: The Companies Law.
The Minister: Minister of Industry and Trade.
The Department: The Companies Controller Department.
The Company: the non-operating foreign companies (Headquarters and regional office) that should be registered in accordance with the Law.
- The definitions contained in the law shall be adopted wherever they are provided for in this regulation.
Article (3):
Furniture and equipment imported by the Company for the setup of its offices in the Kingdom shall be exempted from customs duties and other fees and taxes according to the following conditions:
- Submit an exemption written request to the Controller, enclosed by a detailed list of the furniture and equipment necessary for the company’s office setup, signed and stamped by the company or its legal representative and a copy of the company’s lease contract valid and registered with the Greater Amman Municipality or the competent municipality.
- Conducting a field inspection by the customs department before granting the exemption to make sure that the company’s office space and the number of its employees is suitable with the size of the imported furniture and equipment.
Article (4):
- the company or its legal representative shall submit a singed application for a vehicle temporary entry upon the Controller attached with the following documents:
- A letter issued by the company or its legal representative includes the type of vehicle, the year of manufacture, the license number, the engine capacity and number.
- Copy of the residence permit and / or work permit of the non-Jordanian employee to whom the vehicle will be used.
- Copy of the company’s lease contract valid and registered with the Greater Amman Municipality or the competent municipality.
- The Minister upon the Controller recommendation in justificative cases may allow the company to enter another temporary entry car.
Article (5):
- The application for exemption of samples and commercial forms to be imported by the Company shall be submitted by the representative of the company to the Controller, accompanied by the following documents:
- Copy of the company’s lease contract valid and registered with the Greater Amman Municipality or the competent municipality.
- A detailed list of samples and patterns showing the nature of these models and patterns and the purpose of their import.
- The Company shall not allow the disposal of samples and patterns except for the purposes for which it has been imported and shall marked with a label that it is a free sample not intended for sale.
Article (6):
The Controller may request any additional documents from the Company in order for him to determine the request for exemption and refer it to the relevant authorities.
Article (7):
The Controller shall reject the Company’s request for exemptions if the conditions provided in this regulation not fulfilled in the application or if the Company commits a violation to the provisions of the law and the applicable legislation.
